Since the European Commission presented its White Paper on the modernization of Europe's competition regime two basic assumptions seem to have emerged: By devolving the powers of enforcement that have traditionally been the domain of the European Commission to the Member States, enforcement of competition rules across Europe will be more efficient and effective; As a result more cases will come before the national competition authorities and claims for damages arising from breaches of the competition rules will come before national courts.
