upon the questions, 1st. Whether there is any general license from the United States to enter upon the public lands in California and extract the precious metals, 2d. Whether a patent from the United States, issued upon a confirmation of claims under grants of land in California of the former Mexican government, passes to the patentee the ownership of the precious metals which the land may contain : Biddle Boggs v. The Merced Mining Company, Moore v. Smaw, and Fremont v. Fowler.
