The transition from Roman rule to that of the Agilolfinger is still a dark chapter of Bavarian early history. Within the research of constitutional law of the early medieval lords in the area of the former Roman Empire is the search for continuities and breaks in tradition. With the construct of fiscal succession, the takeover of Roman law and tenure at the disposal of subsequent rulers, the author takes up the continuity aspect as to what extent the new laws are designed on the basis of ancient legal theory. The answer provides a comprehensive look at the development of the Alpine Danube region since the Roman occupation, as well as tradition and application of Roman legal concepts.
